6. The Constitution From Within
The seat writes the reference; the rules for who may hold the seat are part of the reference. A constitution is the doxa about who writes the doxa—the order’s account of its own authorship. Everything difficult and stable in politics descends from this loop.
Converge or diverge
A rule that writes the rule for changing itself can:
- Diverge — holder rewrites succession tighter; each rewrite makes the next cheaper → gradient inside the constitution.
- Converge — succession set beyond easy reach of current holders → order returns to dispersed writing after each holder.
A constitution makes the loop converge by writing who-may-write in harder ink than ordinary policy.
What to harden, what to keep soft

Too little entrenchment → capture road. Too much → freeze ordinary life; temperature death by another path.
Self-designing mechanism under a floor
A constitution is a mechanism: takes contest of self-interested parties, returns who holds the seat next, built so contest does not end in capture. Peculiar features:
- No designer outside after founding—written by parties it binds; must design itself.
- Floor constraint no designer chose—rules out mechanisms whose outcomes write members out.
Impossibility theorems bind here
Pooling references under given weights (economy) escapes classical social-choice impossibilities. Contest over which rule sets the weights does not. Arrow; Gibbard–Satterthwaite: every non-dictatorial rule among three-plus options is manipulable. Choice is dictator or contestable rule—plane’s two corners as theorem. Free corner is labour because the theorem leaves it no rest.
Founding and self-destruction
Who wrote the first rule? No constituted authority can have—authority is what the constitution constitutes. Constituent power: the we prior to office, recognising itself as a people. Foundings are half law, half older than law—the floor speaking before grammar is laid.
May a people, by proper procedure, vote away dispersal or the floor? Procedures draw authority from the equality and dispersal they would abolish. The act, however formal, saws its own ground. Unamendable clauses record the hinge: loop cannot be turned against what makes the loop authoritative.
